These Terms of Use ("Terms") govern your access to and use of Telos, an AI-powered coaching assistant operated by Living With Elea LLC ("Company," "we," "us," or "our"). By creating an account and acknowledging these Terms at signup, you agree to be bound by them.

1. What Telos Is

Telos is an artificial intelligence assistant trained on Consistency Club coaching frameworks, strategies, and materials created by Elea Karras. Telos is designed exclusively to support Consistency Club members with their real estate business development. It is a tool — an extension of the coaching — not a standalone professional service.

2. What Telos Is Not

Telos is not a licensed real estate professional, attorney, financial advisor, tax professional, therapist, or any other licensed professional. All content generated by Telos is for informational and educational purposes only. Nothing Telos produces constitutes legal advice, financial advice, investment advice, tax advice, or professional real estate transactional guidance.

Telos is not Elea Karras. It is an AI assistant trained on her Consistency Club coaching content.

3. AI Disclosure

Telos uses artificial intelligence to generate responses. AI-generated content may contain inaccuracies, errors, or outdated information. You are solely responsible for verifying the accuracy of any content before using it in your business. Always apply your own professional judgment. We are not responsible for any action you take based on Telos's responses.

4. Account Access

Access to Telos requires a valid Consistency Club membership and a current access code provided by Living With Elea LLC. You are responsible for keeping your login credentials confidential. Access codes are non-transferable and may be updated at any time to manage membership access. Sharing your credentials or access code with others is a violation of these Terms and may result in immediate termination of your account.

5. Acceptable Use

You agree to use Telos only for lawful purposes related to your real estate business. You agree NOT to:

• Use Telos to generate content that violates the Fair Housing Act or any applicable anti-discrimination laws
• Attempt to manipulate, override, or circumvent Telos's safety guidelines or content policies
• Share your account credentials or access code with others
• Use Telos to generate spam, harassing content, or any material intended to harm others
• Attempt to reverse-engineer, extract, or replicate Telos's underlying training materials or Consistency Club frameworks
• Use Telos for any purpose other than supporting your own real estate business

6. Earnings and Results Disclosure

The strategies, scripts, templates, and advice provided by Telos are based on Consistency Club coaching frameworks. Individual results will vary significantly based on your market conditions, effort, consistency, experience level, and many other factors entirely outside our control.

Living With Elea LLC makes no guarantees, representations, or warranties regarding income, leads, closings, listings, or any other business results from using Telos or the Consistency Club. Any examples of outcomes or results referenced in Consistency Club materials represent individual experiences and are not typical. They are not a promise or guarantee of what you will achieve.

7. Intellectual Property

All Consistency Club frameworks, strategies, and coaching materials accessed through Telos are the intellectual property of Living With Elea LLC and Elea Karras. You may use outputs from Telos for your own real estate business. You may not resell, redistribute, publish, or claim ownership of the underlying frameworks, training content, or any material that constitutes Consistency Club proprietary content.

8. Disclaimer of Warranties

TELOS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT TELOS WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF TELOS IS ENTIRELY AT YOUR OWN RISK.

9. Hold Harmless and Limitation of Liability

To the fullest extent permitted by applicable law, you agree to hold harmless, defend, and indemnify Living With Elea LLC, Elea Karras, and their respective officers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of or inability to use Telos; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to or generate through Telos.

IN NO EVENT SHALL LIVING WITH ELEA LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF TELOS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF TELOS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR CONSISTENCY CLUB MEMBERSHIP IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

10. Third-Party Services

Telos is powered by third-party AI providers. Your conversations are processed by Anthropic (Claude AI) to generate responses and by OpenAI (embeddings API) to retrieve relevant coaching materials. By using Telos, you acknowledge that your messages are transmitted to these providers. We are not responsible for the practices of these third-party services. Please review their respective privacy policies.

11. Termination

We reserve the right to suspend or terminate your access to Telos at any time, with or without notice, including if your Consistency Club membership lapses, your access code is no longer valid, or you violate these Terms. Upon termination, your right to use Telos ceases immediately.

12. Changes to These Terms

We may update these Terms at any time. Continued use of Telos after changes are posted constitutes your acceptance of the updated Terms. We will make reasonable efforts to notify you of material changes.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of Telos shall be resolved exclusively in the courts of that state.
